Terms of Service

These terms govern your use of Splatimation. By creating an account or using the service, you agree to them. Please read them alongside our Privacy Policy.

Who we are

Splatimation is operated by Ontia Ltd ("Ontia", "we", "us"), a company registered in England and Wales (company number 16999002), registered office 167-169 Great Portland Street, 5th Floor, London, W1W 5PF.

Your account

You must be at least 16 years old and old enough to form a binding contract in your country to use Splatimation. You must provide accurate information and keep your login secure. You are responsible for activity under your account.

Your content

• You own what you upload. You keep all rights to the splat files, projects and tours you create. We do not claim ownership of your content.
• You grant us a licence to run the service. You give us the permission needed to store, process, display and deliver your content so we can provide Splatimation to you and, where you choose, to people you share or publish to.
• You are responsible for your content. You confirm you have the rights to anything you upload and that it does not infringe others' rights or break the law.
• Captures of real-world scenes. A Gaussian splat may capture recognisable people, vehicles or private property. You confirm that you have any necessary rights, permissions or consents to capture, upload and publish such imagery, and that doing so complies with privacy and data-protection law. You agree to indemnify Ontia Ltd against claims arising from content you upload or publish in breach of these terms.

Removal requests

If you appear in, or own property shown in, content published on Splatimation and want it removed, or if you believe content infringes your rights, email privacy@splatimation.com. We will review and, where appropriate, remove or restrict the content.

Acceptable use

You agree not to:

• Upload content that is illegal, infringing, or violates the rights or privacy of others.
• Attempt to break, overload, reverse-engineer or gain unauthorised access to the service.
• Resell or redistribute the platform itself, or use it to build a directly competing service.

We may suspend or remove content or accounts that breach these terms.

Plans, billing and cancellation

• Paid plans are billed in advance through Stripe on a recurring basis until cancelled.
• You can cancel any time. Your plan stays active until the end of the current billing period; we do not provide pro-rated refunds for partial periods unless required by law.
• We may change pricing with reasonable notice; changes apply to the next billing period.

Marketplace

If you list a project for sale, you confirm you have the right to sell it and grant buyers the licence described at the point of sale. We charge a platform fee on sales, shown before you list. Transactions are processed by Stripe. We are not party to the licence between buyer and seller and provide the marketplace "as is".

Hosting and custom domains

Paid hosting add-ons let you publish tours on your own domain. You are responsible for your domain registration and for the content you publish. Service levels for hosting are described where the add-on is offered.

Service availability

We work to keep Splatimation available and reliable, but the service is provided "as is" without warranties. We may change, suspend or discontinue features. We are not liable for indirect or consequential losses, to the extent permitted by law.

Termination

You can stop using Splatimation and delete your account at any time. We may suspend or end your access if you materially breach these terms.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.

Changes to these terms

We may update these terms from time to time. We will revise the "last updated" date above and, for material changes, give clearer notice. Continued use after changes means you accept the updated terms.
